Terms of Service

These Terms of Service govern the services provided by Bay Asset Care (“Company,” “we,” “our,” or “us”) to the client (“Client,” “you,” or “your”). By engaging our services, you agree to the terms below.
1. Scope of Services
Bay Asset Care provides scheduled property maintenance, home watch, short-term rental support, RV checks, RV lot visits, and marine care services. Services are limited to visual inspections, preventative maintenance, minor repairs, and coordination of third-party vendors.
We do not provide property management, cleaning services, emergency response, on-call services, licensed contracting, plumbing, electrical, HVAC, or marine mechanical services.
2. Scheduled Services Only
All services are performed on a scheduled basis only. Bay Asset Care does not provide emergency, after-hours, or guaranteed same-day service.
3. Not a Licensed Contractor
Bay Asset Care is not a licensed contractor, electrician, plumber, HVAC technician, or marine mechanic. Any work requiring specialized licensing will be recommended for referral to, or coordination with, qualified licensed professionals.
4. Visual Inspections and No Guarantee
Client understands that inspections and checkups are visual and observational in nature. Bay Asset Care does not guarantee the detection of all issues, defects, leaks, failures, hazards, or damage. Conditions may change between visits and may be outside our control.
5. Limitation of Liability
To the fullest extent permitted by law, Bay Asset Care shall not be liable for hidden defects, pre-existing conditions, weather-related damage, storm damage, theft, vandalism, water damage, mold, pest activity, structural failures, equipment failures, or issues occurring between visits.
Any liability shall be limited to the amount paid for the specific service visit in question.
6. Marine and RV Services Disclaimer
Marine and RV services are limited to visual checks, basic maintenance, and condition reporting. We do not operate vessels, perform engine repairs, guarantee seaworthiness, or guarantee operational condition of any boat or RV.
7. Vendor Coordination
At the Client’s request, Bay Asset Care may help coordinate with third-party vendors, contractors, cleaners, repair providers, or service professionals. Bay Asset Care is not responsible for vendor pricing, workmanship, schedules, delays, damages, or outcomes.
8. Client Responsibilities
Client agrees to provide safe access to the property, disclose known hazards or issues, maintain appropriate insurance coverage, and ensure utilities are active when needed for requested services.
9. Property Access
Client authorizes Bay Asset Care to access the property, RV, boat, dock, or site for scheduled services. Bay Asset Care is not responsible for security system failures, unauthorized third-party access, or pre-existing security vulnerabilities.
10. Payment Terms
Payment is due as agreed before or at the time of service. Additional charges may apply for materials, parts, extended labor, additional visits, or services outside the original requested scope.
11. Cancellations and Rescheduling
Scheduled services may be rescheduled with reasonable notice. Missed appointments, denied access, unsafe conditions, or incomplete access instructions may result in service charges.
12. Indemnification
Client agrees to indemnify and hold harmless Bay Asset Care from claims, damages, losses, or liabilities arising from property conditions, use of the property, third-party vendor work, events outside our control, or services requested by the Client.
13. Insurance
Client is responsible for maintaining appropriate property, liability, flood, storm, RV, and marine insurance coverage as applicable. Bay Asset Care does not insure Client property, contents, boats, vehicles, RVs, docks, or structures.
14. Governing Law
These Terms shall be governed by the laws of the State of Florida.
15. Acceptance of Terms
By using Bay Asset Care services, Client acknowledges that they have read, understood, and agreed to these Terms of Service.
